Terms of Service

Please review the terms and conditions that govern your use of Circuit Swarm.

These Terms of Service ("Terms") govern your access to and use of the Circuit Swarm mobile application (the "App") provided by Circuit Swarm LLC ("Circuit Swarm," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 13 years of age (or the applicable age of consent in your jurisdiction), that you have the legal capacity to enter into a binding agreement, and that you agree to comply with these Terms. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Circuit Swarm provides a mobile application designed to assist electricians, IT professionals, and property owners in mapping and documenting building electrical circuits. The App works in conjunction with Circuit Swarm's specialized hardware devices. The service includes circuit identification and mapping features, data storage and synchronization through cloud services, and the ability to export and share circuit mapping data.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or that are inactive for an extended period.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable federal, state, local, or international law or regulation
  • Attempt to gain unauthorized access to any part of the App, other accounts, or any systems or networks connected to the App
  • Use the App to transmit any viruses, malware, or other malicious code
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Copy, modify, distribute, sell, or lease any part of the App or its content
  • Use any automated means to access the App or collect data from the App
  • Interfere with or disrupt the integrity or performance of the App or its related systems

5. Intellectual Property

The App, including all content, features, functionality, design, text, graphics, logos, and software, is owned by Circuit Swarm LLC and is protected by United States and international copyright, trademark, patent, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App except for the limited license to use the App as described herein. You may not use our trademarks, trade names, or branding without our prior written consent.

6. User Content

You retain ownership of any data, circuit maps, notes, and other content you create within the App ("User Content"). By using the App, you grant Circuit Swarm a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the App's services to you. We do not claim ownership of your User Content, and we will not use it for any purpose other than operating and improving the App.

7. Third-Party Services

The App uses Google Firebase for authentication, data storage, and analytics. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services. The App does not integrate with any social media platforms.

8. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Circuit Swarm is a tool designed to assist with electrical circuit identification and mapping. It is not a substitute for professional electrical expertise, inspection, or safety practices. Users are responsible for verifying all circuit mapping results and ensuring compliance with all applicable electrical codes and safety standards. Electrical work should only be performed by qualified professionals.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CIRCUIT SWARM LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Circuit Swarm LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of any third party.

11. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may terminate your account at any time by contacting us at founder@circuit-swarm.com. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively in the state or federal courts located in Albany County, New York, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App and updating the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Circuit Swarm LLC only, and not with Apple Inc. ("Apple"). Circuit Swarm, not Apple, is solely responsible for the App and its content.
  • Your use of the App must comply with the Apple App Store Terms of Service.
  • Circuit Swarm is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • Circuit Swarm, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
  • In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Circuit Swarm, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Circuit Swarm LLC regarding your use of the App and supersede any prior agreements or understandings, whether written or oral.
